By downloading, accessing, or using QuoteCat ("the App"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

QuoteCat is a mobile application designed for contractors and construction professionals to create, manage, and share professional quotes. The service includes:

• Quote creation and management tools
• Material and labor cost calculations
• PDF generation and sharing
• Product catalog with pricing data
• Cloud storage and synchronization (Pro/Premium tiers)
• Custom branding options (Premium tier)

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use QuoteCat. By using the App, you represent and warrant that you meet these requirements.

4. Account Registration

Free Tier

Free tier users may use the App without creating an account. Data is stored locally on the device only.

Pro and Premium Tiers

Pro and Premium subscribers must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

5. Subscription Plans and Payments

Free Tier

• Unlimited draft quotes, limited to 10 client exports (PDF)
• Local storage only (no cloud sync)
• No payment required

Pro Tier

• Unlimited quotes and PDF exports
• Cloud backup and multi-device sync
• Custom job templates
• Monthly or annual subscription

Premium Tier

• All Pro features
• Company branding on quotes
• Quote Wizard (AI-assisted)
• Advanced analytics and team collaboration
• Priority support

Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed through Apple App Store or Google Play Store
• Prices are subject to change with 30 days notice
• You authorize us to charge your payment method for recurring subscription fees

Cancellation and Refunds

• You may cancel your subscription at any time through your App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Upon cancellation, you retain access until the end of your paid period
• Refunds are handled according to Apple App Store or Google Play Store policies

6. Acceptable Use

You agree to use QuoteCat only for lawful purposes. You may not:

• Use the App for any illegal or fraudulent activities
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright or proprietary notices
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Use the App to send spam or unsolicited communications
• Share your account credentials with others
• Scrape or copy pricing data for competing services

7. Intellectual Property

QuoteCat's Rights

QuoteCat and all related trademarks, logos, and content are owned by QuoteCat.ai. We grant you a limited, non-exclusive, non-transferable license to use the App according to these Terms.

Your Content

You retain ownership of all quotes, customer data, and content you create in QuoteCat. By using our cloud storage service, you grant us permission to store, backup, and process your data to provide the service.

Third-Party Data

Material pricing data is provided by 1Build and other third-party suppliers. This data is subject to their respective terms and conditions.

8. Pricing Data Disclaimer

We are not responsible for:

• Accuracy of third-party pricing data
• Price fluctuations or changes
• Material availability
• Financial losses due to pricing discrepancies

9. Warranty Disclaimer

QUOTECAT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted or error-free
• Warranties regarding accuracy, reliability, or completeness of data

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUOTECAT SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from errors in pricing data
• Damages from unauthorized access to your account
• Damages exceeding the amount you paid for the service in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless QuoteCat, its affiliates, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Quotes you provide to your customers

12. Data Backup and Loss

While we implement backup procedures for Pro and Premium accounts, you are responsible for maintaining your own backups of critical data. We are not liable for data loss due to:

• Technical failures or errors
• Account deletion
• Service interruptions
• Device loss or damage (Free tier)

13. Service Modifications and Termination

Our Right to Modify

We reserve the right to:

• Modify or discontinue features at any time
• Update pricing with 30 days notice
• Change these Terms (we will notify you of material changes)

Our Right to Terminate

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the service in a way that harms our systems or other users

14. Third-Party Services

QuoteCat integrates with third-party services (1Build, Supabase, payment processors). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services' performance or policies.

15. Governing Law and Disputes

Dispute Resolution
